Kommunity Malta Agency, the Maltese government body responsible for processing citizenship applications, has published an official statement concerning the recent ruling by the Court of Justice of the European Union (CJEU). The judgment calls for Malta to terminate its Citizenship by Investment Programme.
In its press release, the Government of Malta clarified that all citizenships granted under both the current and previous legislative frameworks remain valid and unaffected by the Court’s decision. Individuals who have already acquired Maltese citizenship will retain their status.

The Government of Malta also stated that it respects the decisions of the courts. At this stage, the legal implications of the judgment are being studied in detail, with the aim of aligning the regulatory framework on citizenship with the principles outlined in the ruling.
The CJEU considers citizenship by investment programmes to be a commercialization of citizenship, a misconception that undermines the sovereign right of states to attract capital and talent through structured citizenship programmes. Malta’s programme has always operated with transparent and objective rules, supported by a rigorous, multi-tiered due diligence process.
Malta’s approach is consistent with that of other sovereign states, including the United States, Canada, the United Arab Emirates, and Singapore, which also offer reputable investment migration programmes.
